1.1 These Terms and Conditions ("Terms") govern access to and use of the website located at [URL] (the "Website") and the purchase of products offered for sale on the Website (the "Products").
1.2 The Website is owned and operated by Mediaid Holdings Sdn. Bhd. (Company Registration No. [202601004736]), a company incorporated in Malaysia with its registered office at [Colony @ The MET, Mont Kiara, THE MET CLUB by Colony, A-10-02, Menara The Met, No. 20, Jalan Dutamas 2, 50480 Kuala Lumpur] ("the Company", "we", "us" or "our"). "NOVV STRIPS" is a trading name of Mediaid Holdings Sdn. Bhd.
1.3 By accessing the Website or placing an order, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website.
1.4 We reserve the right to amend these Terms from time to time. The version of the Terms published on the Website at the time an order is placed shall apply to that order.
2.1 By placing an order, you represent and warrant that you are at least eighteen (18) years of age, or that you have obtained the consent of a parent or legal guardian.
2.2 The Products are offered for personal, non-commercial use only. We reserve the right to refuse or limit orders which we reasonably believe are placed for the purpose of resale.
3.1 The Products are drug-free external nasal strips intended for general consumer use to support nasal airflow during sleep, exercise and daily activity.
3.2 The Products are not medicines and are not intended to diagnose, treat, cure or prevent any disease or medical condition. No content on the Website constitutes medical advice. Customers with medical concerns should consult a registered medical practitioner.
3.3 The Products must be used in accordance with the instructions provided. The Products should be applied only to clean, dry and intact skin; should not be used on broken, irritated or damaged skin; are single-use; and are intended for adult use. Use should be discontinued if irritation occurs.
3.4 Product images on the Website are for illustrative purposes only. Actual products may vary slightly in colour or packaging.
3.5 While we make reasonable efforts to ensure the accuracy of information on the Website, we do not warrant that all product descriptions, pricing or other content is error-free.
4.1 The placement of an order constitutes an offer by you to purchase the Products. All orders are subject to acceptance by us.
4.2 A binding contract is formed only upon our issuance of an order confirmation, or upon dispatch of the Products, whichever occurs first.
4.3 We reserve the right to refuse or cancel any order, in whole or in part, including without limitation where: (a) the Product is unavailable; (b) there is an error in pricing or product information; (c) payment cannot be processed or verified; or (d) we reasonably suspect fraud or unauthorised or resale activity. Where an order is cancelled after payment has been received, a full refund will be issued.
4.4 You are responsible for ensuring the accuracy of all order information, including the delivery address.
5.1 All prices are stated in Malaysian Ringgit (RM) and, unless otherwise stated, are inclusive of applicable taxes. Delivery charges, where applicable, will be displayed prior to checkout.
5.2 Payment must be made at the time of order through the payment methods made available on the Website. Payments are processed by third-party payment service providers. We do not store complete payment card details.
5.3 We reserve the right to revise prices at any time. Price revisions shall not affect orders already confirmed.
5.4 Promotional and discount codes are subject to their stated terms, have no cash value, and may be withdrawn or cancelled in the event of error or misuse.
6.1 Where a subscription option is offered, by subscribing you authorise recurring charges to your selected payment method at the frequency and price displayed at the time of subscription, until the subscription is cancelled.
6.2 Subscriptions may be cancelled at any time through your account or by written notice to [EMAIL]. Cancellation shall take effect from the next billing cycle. Orders already processed and dispatched shall be governed by Clauses 7 and 8.
6.3 We shall provide reasonable prior notice of any change to subscription pricing. You may cancel the subscription before such change takes effect.
7.1 Delivery is available within Malaysia and is performed by third-party courier providers. Delivery timeframes stated on the Website are estimates only and are not guaranteed.
7.2 Risk in the Products shall pass to you upon delivery to the address specified in the order. Title in the Products shall pass upon receipt of payment in full.
7.3 If an order is not received within a reasonable period after the estimated delivery date, or arrives damaged, you should notify us at [EMAIL]. We will arrange redelivery, replacement or refund as appropriate.
8.1 Nothing in these Terms excludes, restricts or modifies any right or remedy conferred on you by the Consumer Protection Act 1999 (Malaysia) or any other applicable law which cannot lawfully be excluded.
8.2 Products which are defective, damaged on arrival, or not as described will be replaced or refunded at no cost to you, upon verification.
8.3 For hygiene reasons, Products which have been opened or unsealed cannot be returned or refunded except where they are defective or otherwise required by law. Unopened Products in their original sealed condition may be returned within fourteen (14) days of delivery for a refund of the Product price. Return shipping costs for change-of-mind returns shall be borne by the customer.
8.4 Approved refunds will be processed to the original payment method within a reasonable period.
9.1 By submitting reviews, images or other content to the Website or to our official social media channels, or by consenting to be featured, you grant the Company a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish and display such content for the purposes of marketing and promoting the NOVV STRIPS brand. You may withdraw consent to future use at any time by written notice to [EMAIL].
9.2 We reserve the right to decline to publish content which is unlawful, defamatory, offensive, or which makes medical or therapeutic claims in respect of the Products.
10.1 All intellectual property rights in and to the Website and its content, including without limitation the trade marks "NOVV", "NOVV STRIPS", "IT'S NOVV OR NEVER", "STRIP NOVV" and "MORE AIR", and all logos, designs, text, graphics and product designs, are owned by or licensed to the Company.
10.2 No licence or right is granted to use any of the foregoing except as strictly necessary to access and use the Website for personal, non-commercial purposes.
11.1 You agree not to: (a) use the Website for any unlawful purpose; (b) attempt to gain unauthorised access to the Website or its systems; (c) introduce viruses or other malicious code; (d) extract data from the Website by automated means without our written consent; or (e) place fraudulent orders.
11.2 The Website may contain links to third-party websites, including the NOVV digital health platform, which is operated as a separate service under its own terms and privacy notice. We accept no responsibility for the content or practices of third-party websites.
12.1 Nothing in these Terms excludes or limits any liability which cannot be excluded or limited under applicable Malaysian law.
12.2 Subject to Clause 12.1, the Company shall not be liable for: (a) any loss or damage arising from use of the Products otherwise than in accordance with their instructions; (b) any indirect, incidental, special or consequential loss; or (c) any loss of profit, revenue, data or goodwill.
12.3 Subject to Clause 12.1, the Company's total aggregate liability arising out of or in connection with any order shall not exceed the total amount paid by you for that order.
12.4 The Website is provided on an "as is" and "as available" basis. We do not warrant that the Website will be uninterrupted, timely or error-free.
13.1 Personal data provided in connection with the Website and any order will be processed in accordance with our Privacy Policy and the Personal Data Protection Act 2010 (Malaysia). The Privacy Policy is incorporated into and forms part of these Terms.
14.1 Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14.2 No waiver. No failure or delay by the Company in exercising any right under these Terms shall operate as a waiver of that right.
14.3 Assignment. The Company may assign or transfer its rights and obligations under these Terms to any successor of the NOVV STRIPS business. Your statutory rights shall not be affected by any such assignment.
14.4 Force majeure. The Company shall not be liable for any failure or delay in performance arising from causes beyond its reasonable control.
14.5 Governing law and jurisdiction. These Terms shall be governed by and construed in accordance with the laws of Malaysia. The parties submit to the non-exclusive jurisdiction of the courts of Malaysia. Nothing in this clause limits your right to bring proceedings before the Tribunal for Consumer Claims Malaysia where applicable.
